The Court of Appeal has reserved its decision in the constitutional challenge filed by Opposition Leader Azruddin Mohamed and his father, Nazar Mohamed, after hearing arguments from the parties on Tuesday.
Acting Chancellor of the Judiciary, Justice Roxane George-Wiltshire, SC, indicated that the court would make every effort to deliver its ruling, while acknowledging the extensive material requiring consideration.
She pointed to the volume of submissions and legal authorities placed before the court, noting that the material exceeds 2,000 pages.
The proceedings concern the constitutionality of provisions of the Fugitive Offenders Act, which governs aspects of the extradition case brought against the Mohameds at the request of the United States.
The father and son are challenging aspects of the legislation as part of their efforts to contest the legal basis of the extradition proceedings.
The constitutional matter has implications for the continuation of the extradition case before Chief Magistrate Judy Latchman, which has been allowed to proceed, although a final ruling cannot be delivered until the constitutional issues are resolved.
The United States is seeking the extradition of the Mohameds to face criminal charges there.
